Washington Consumer Health Data Privacy Notice

This Washington Consumer Health Data Privacy Notice (“Privacy Notice”) supplements the information in the Bauerfeind USA Inc. Privacy Policy, available here (our “General Privacy Policy”). It applies to Washington consumers who interact with Bauerfeind USA Inc. (“Bauerfeind”, “we”, “us”, or “our”) in an individual or household capacity and applies only to personal information defined as “consumer health data” subject to the Washington My Health My Data Act.
This Privacy Notice describes what consumer health data we collect, how we collect and use it, who we disclose it to and why, and the choices you may have regarding our use or disclosure of your consumer health data. “Consumer health data” is a subset of personal information that identifies your past, present, or future physical or mental health status. Examples of consumer health data are provided below.
Please read this Privacy Notice carefully to understand our policies and practices regarding your consumer health data and how we treat it.
Consumer Health Data We Collect
We may collect several types of consumer health data from and about our customers and other users of the websites owned and operated by Bauerfeind (“Websites”), such as:
- Health Information: We collect health-related information when you provide it to us, including when: you purchase products; you provide measurements for made-to-measure products; you use the Bauerfeind Support chat at the bottom of the page asking for product recommendations; you provide your information to one of our business partners in order to receive our products or services; or make other requests. This information may include:
- Information identifying a health condition, treatment, disease, or diagnosis, such as purchases of certain products to treat an identifiable health condition
- Information identifying a health-related surgery or procedure, such as purchase of a post-treatment garment or product
- Information that identifies an individual’s intention to seek health care
- Information to collect measurements for made-to-measure products and to determine the correct size for a product
- Information collected to recommend products or provide provider referrals
- Location: We use various technologies to learn your general geographic location, including by collecting your IP address or other device information, which may depend on your device’s settings for location services.
- Insurance Information: We may collect information about your insurance when you provide that information to us or to one of our business partners.
- Inferences: We may use data that is not consumer health data to draw inferences such as consumer preferences, behavior, and characteristics that are then used to associate you with the information listed above.
Categories of Sources from Which We Collect Consumer Health Data
We may collect the consumer health data described above from different sources, as described in the How We Collect Your Information section of the General Privacy Policy. Providers or business partners are responsible for obtaining appropriate, legally compliant informed consent prior to disclosing your health data to us.
Purposes for Collecting Your Consumer Health Data
We may use the consumer health data we collect for the following purposes:
- Providing and improving our products and services, such as delivering or recommending our products and services to you; fulfilling orders and processing transactions; responding to your communications, inquiries, and feedback; processing your requests, purchases, transactions, and payments and preventing transactional fraud; improving your experience on our Websites; and understanding how people use our products and services.
- Communicating with you about products, services and promotions such as by sending marketing communications, promotional information, including information about benefits and discounts, and advertisements that may be of interest to you (“Promotional Material”) by various means.
- Serving content on our Websites, developing and analyzing our services, and improving our customers’ experience, including but not limited to, troubleshooting customer service issues and improving site functionality and effectiveness.
- Presenting advertising online and via email, or other communication channels, including through partnerships with social media platforms and internet search engines.
- Analyzing your activity with us, including your interactions with our Websites and emails or other forms of communication, and monitoring the effectiveness of our advertising and communications.
- Personalizing our relationship with you, including presenting customized communication, advertising, and experiences on our Websites, emails, and ads on social media, including by providing you with interactive or personalized elements, services, and offers, including on our Websites or third-party websites and applications.
- Providing support and responding to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
- Pursuing our business purposes, including but not limited to conducting data analysis and detecting, preventing, and responding to actual or potential fraud, illegal activities, or intellectual property infringement.
- Maintaining the safety, security, and integrity of our Websites, as well as our products and services, databases, and other technology assets and business.
- Conducting testing, research, analysis, and product development, including to develop and improve our Websites, products, and services.
- Protecting legal interests, such as by complying with our legal obligations, responding to legal process or requests for information issued by government authorities or other third parties, or to protect your, our, or others’ rights.
- Evaluating business transactions such as conducting a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by Bauerfeind about you is among the assets transferred.
We may combine the consumer health data that we collect to advance any of these purposes.
How We Share Your Consumer Health Data
We may share any of the categories of consumer health data listed in Consumer Health Data We Collect within Bauerfeind USA, Inc. and with Bauerfeind AG.
If you contact us while traveling outside the United States, the Bauerfeind entity in your current location may collect and share your information with us to assist with your request.
We may also share these categories of consumer health data with third parties for certain business purposes. In particular, we may share consumer health data:
- - With your consent, to complete transactions or provide products or services you have requested, and for the
purposes described herein.
- - With our service providers as necessary to further the purpose of disclosure or provide the product or products
requested.
- - With governmental agencies or legal bodies to comply with our legal obligations.
- - With purchasers of or successors to our business or assets.
Your Washington State Privacy Rights
If you are a resident of Washington, you may have the right to (1) request access to your consumer health data; (2) confirm whether we have disclosed or sold your consumer health data; (3) delete your consumer health data; or (4) withdraw your consent or authorization relating to such data.
If you wish to exercise the rights listed above, you may submit a request by emailing info@bauerfeindusa.com, by calling us at 1 (800) 423-3405, or by using this form. We will provide your consumer health data to you in writing in a readily usable format. If you choose to submit your request via email, you must include “Privacy Rights Request” in the subject line and clearly provide us with the following information: what type of request you are making, your full name, email address, and business address. You may only make one request per email.
We are required to provide you with access to your personal health data or delete personal health data only in response to verifiable or authenticated requests. We will compare the information you provide in your request with any information we may have in our possession in order to verify your request. We may also contact you to request additional information in relation to your request. The information you provide must match the information we have in our possession. This measure is in place to help ensure that personal health data is not disclosed to any person who does not have the right to receive it. The information collected through this process will be used for verification purposes only.

How To Submit an Appeal
